The material information rules already shaping what your listing must show
The requirement for property listings to include specific, defined material information has been building since 2022 and is already in force across all three of its published parts. For sellers preparing to market a home, understanding what the rules require, what agents are obliged to ask for, and where the direction of travel is heading is the most practical preparation available before any listing goes live.

What material information means and why it applies
Material information is defined as information which an average consumer needs, in the context of a property listing, to make an informed transactional decision. Under the Consumer Protection from Unfair Trading Regulations 2008, agents are legally obliged not to omit or hide material information from property listings. The National Trading Standards Estate and Letting Agency Team published detailed guidance to clarify precisely what that obligation requires, in three phases.

Part A: Already required since 2022
Part A material information has been required in property listings since May 2022. It covers three categories of information that must appear on the front page of any listing: the asking price as an actual figure rather than a range, the council tax band or equivalent rating, and the tenure of the property, specifically whether it is freehold, leasehold, or shared ownership. For sellers, this means your agent will need the council tax band confirmed, your tenure clearly established, and your asking price set as a specific figure before the listing is published.

Parts B and C: In force since November 2023
Parts B and C were published in November 2023 and are now in force. Part B covers information that applies to all properties. It includes a clear description of the property type, such as whether it is a house or flat and which floor an apartment is on, the construction materials used, the number and types of rooms, information about utilities including the type of electricity meter, water supply, and drainage, and details about parking. This information does not need to appear on the front page of a listing but must be accessible within one click for online listings.

Part C covers information that only applies where a property is affected by the relevant issue. The most significant Part C categories include flood risk, where the property falls within an Environment Agency flood zone; Japanese knotweed or other invasive plants; planning permissions or restrictions affecting the property; issues with building safety, particularly relevant for flats; and whether the property is listed or in a conservation area. Where any of these apply to a specific property, they must be disclosed.

What this means for sellers
Agents are required to verify the information they include. Sellers should expect to be asked more detailed questions about their property before it is listed than was previously the case. Gathering the relevant documentation in advance, including the title register for tenure details, any planning history, building safety certificates where applicable, and EPC documentation, reduces the time between instruction and live listing and removes a common source of early transaction delay.

Where the rules are heading
On 19 June 2026, the government published a Home Buying and Selling Reform Roadmap announcing its intention to introduce upfront sales packs at the point of listing, containing information about a property's condition, leasehold costs, and chain status. The government's aim is to cut transaction times by approximately four weeks and reduce the proportion of sales that fall through. These are proposals that will require further development and legislation before becoming mandatory. The material information framework already in force is the foundation on which that expanded requirement will build.
